These Terms & Conditions (“Terms”) govern your use of the Drop2Hittin3 iOS app, the web app at app.drop2hittin3.com, and this marketing site at drop2hittin3.com (collectively, the “Service”). The Service is operated by Drop2Hittin3 LLC (“we”, “us”, “our”).

1. Acceptance of Terms

By creating an account or using Drop2Hittin3, you agree to these Terms & Conditions. If you do not agree, you must stop using the app.

2. Eligibility

You must be at least 13 years old to use Drop2Hittin3. If you are under 18, you must have permission from a parent or legal guardian. The App Store age rating for the iOS app is 17+ because of user-generated content.

3. Your Account

You are responsible for keeping your login credentials secure, for all activity under your account, and for providing accurate information. We may suspend or terminate accounts that violate these Terms. Pick a username that doesn’t impersonate someone else, infringe a trademark, or violate our content rules.

4. User Content

You retain ownership of the photos, videos, golf scores, comments, and other content you post (“User Content”). By posting, you grant Drop2Hittin3 LLC a non-exclusive, worldwide, royalty-free license to display, host, store, reproduce, and distribute your content to operate and improve the platform. You may delete your content at any time.

You promise that:

You created your content or have the rights to post it.
Your content doesn’t infringe anyone else’s copyright, trademark, privacy, or publicity rights.
People in your photos and videos consented to being shared (or are in a public setting where consent is not legally required).

5. Prohibited Content & Behavior

You agree not to post or engage in harassment, hate speech, nudity, illegal activity, spam, unauthorized advertising, or posting others’ private information without consent. Specifically, do not post or send content that is:

Sexually explicit, pornographic, or graphically violent;
Hate speech, harassment, bullying, or threats;
Self-harm or suicide promotion;
Illegal, or that promotes illegal activity;
Sharing someone’s private information without consent;
Impersonating another person or organization;
Spam, scams, or fraudulent solicitations;
Designed to harm the Service (malware, exploits, scraping, rate-bombing, attempts to bypass security rules).

Reports of objectionable content are reviewed and acted on within 24 hours. We may remove content or suspend accounts that violate these rules, and repeat violations result in account termination.

6. Golf Score & Performance Data

You agree not to falsify or manipulate golf score data. Posted scores may be visible to other users, and you are responsible for any claims you make. Scorecard math, course information from third-party providers, and the optional UOHC handicap calculation are best-effort. The UOHC is not an official USGA handicap and shouldn’t be used for sanctioned competition.

7. Intellectual Property

All Drop2Hittin3 trademarks, logos, designs, and software are owned by Drop2Hittin3 LLC. You may not copy, modify, or distribute any part of the platform without permission.

8. No Copying, Reverse Engineering, or Competitive Use

By creating an account or using Drop2Hittin3, you agree that you will not:

Copy, reproduce, or replicate any part of the Drop2Hittin3 platform;
Reverse engineer, decompile, or attempt to extract the source code;
Use the app to gather information, data, or design elements for the purpose of creating or launching a competing product;
Scrape or collect data for competitive analysis;
Create derivative works based on Drop2Hittin3’s design, features, branding, or proprietary concepts.

Drop2Hittin3 LLC reserves the right to suspend or terminate accounts that violate this section and pursue legal remedies for unauthorized competitive use.

9. App Modifications

We may update, modify, or discontinue features at any time and are not liable for any resulting loss. We’ll try to give you notice for big changes.

10. Third-Party Services

Drop2Hittin3 may integrate with third-party services. We are not responsible for the actions or policies of third-party providers.

The iOS app is also licensed to you under Apple’s standard EULA for App Store apps. If anything in these Terms conflicts with Apple’s EULA, Apple’s EULA controls for the iOS app. Apple is not a party to these Terms and has no obligation to provide support for the app — that’s us.

11. Termination

We may suspend or terminate your account for violating these Terms, harming the platform, or engaging in fraudulent or illegal activity. You may delete your account at any time from inside the app: Profile → Settings → Delete Account. When you do, we run a 30-day grace period:

Immediately on request: your profile is hidden from everywhere on the Service — search, feeds, follower lists, tag suggestions, post details, profile pages. Other users see your posts and comments appear from “[deleted user]” or are hidden entirely, depending on context. You’re signed out of every device.
Within 30 days: you can change your mind. Sign in again with the same email and password, confirm the prompt to restore your account, and everything comes back — posts, photos, followers, messages, the lot.
After 30 days: a scheduled process permanently erases your profile, posts, scorecards, photos, videos, comments, likes, follow relationships, messages you sent, notifications, and your authentication record. Group conversations remain intact for the other participants but your name is removed. Backups and legal-hold copies are rolled off on the same schedule.

Some content is impossible to fully remove because it has been copied or shared by others outside the Service (e.g., screenshots). Reports you filed and moderation logs may be retained up to 12 months for safety reasons even after your account is gone.

12. Disclaimers

Drop2Hittin3 is provided “as is” without warranties of any kind. We do not guarantee continuous service, accuracy of user content, or availability of features.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

Drop2Hittin3 LLC is not liable for loss of data, damages from user content, unauthorized access, or indirect, incidental, or consequential damages.

TO THE FULLEST EXTENT PERMITTED BY LAW, DROP2HITTIN3 LLC AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY IS LIMITED TO THE GREATER OF (a) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (b) USD $100.

You’ll defend, indemnify, and hold us harmless from any claim, cost, or damage that arises out of (a) your content, (b) your use of the Service in violation of these Terms, or (c) your violation of someone else’s rights.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction there.

15. Changes to Terms

We may update these Terms and will notify users of significant changes. When we make material changes, we will update the “Last updated” date at the top and, if appropriate, surface a notice in the app. Continued use of the Service after an update means you accept the revised Terms.
